UPDATE: June 1 Discovery Hearing Subpoenas Sheriff & RC Deputies Held Open

Due to the unavailability of witnesses on June 1, Defense Attorney Garland F. Byers, Jr. asked the Superior Court judge to keep this caser open to be heard later this session. Byers told the judge that it was possible that he and the District Attorney may come to agreement on some of the issues. The case is expected to be called next week.

In the State of North Carolina versus Bruce WAYNE GIVENS, Jr case, defense attorney Garland F. Byers, Jr. will petition the court for the relief sought in the Defendant’s Motion for Discovery of Communications with the Defendant by Law Enforcement to be heard in Rutherford County Superior Court on June 1, 2021 at 9:30 A.M. Citing the United States Constitutional, the North Carolina Constitution, relevant case law and the N. C. Gen. Stature 115A-903, the request is for an order commanding the Sheriff of Rutherford County and the District Attorney to provide copies of any and all documentation of any and all meetings, interviews, telephone calls, text messages, instant messages, and any and all other forms or types of communication with the Defendant in connection to all charges.

If no documentation is found, the Defendant requests that any law enforcement officer with knowledge of such communication reduce that knowledge to writing and provide to the District Attorney for disclosure to the Defendant. Sheriff Chris Francis, Deputies Chadd Murray, Jamie Mode, Zack Walker, Wilmer Chavez-Perez, Tyler Green, Dylan Henderson, and Patrick Wiseman. Motions have been made to consider the witnesses as hostile.
